Warranty of Goods

Basically, if you have a problem with your product within the given warranty time, you will be able to contact emBeadT to handle the return. The warranty covers repair or replacement only. emBeadT does not provide compensation for shipping fees for warranty service.

Product Availability

When we say an item is in stock, we mean it. In rare cases, however, we may take your order and then discover that the product is not available for shipping. In this case, we will notify you via e-mail that it is on back order and do our utmost to fulfill the order as soon as possible. You will also have the option to cancel the order.

The types of personal information we collect include all the information entered on the Order Form pages: shipping and billing name and address, email address, phone number and credit card information. We collect this information from you using PayPal backend services.

We use the information you provide when placing an order to complete that order. We do not share this information with outside parties except to the extent necessary to complete that order or to provide services where the outside party is acting on our behalf and has no independent right to use the information we provide (i.e. a third party shipping or customer support center).

We use aggregate information to better design our Web site and to share with potential business partners. For example, we may tell a potential partner that X number of individuals visited a certain area on our website, or that Y number of people from a certain zip code purchased certain items, but we would not disclose anything that could be used to identify those individuals.

We may contact you from time to time regarding your order status or about products or specials that we think you may be interested in. If you do not wish to receive these notifications, we will honor your request not to send them to you.

We use return email addresses from your email correspondence to us to answer the email we receive. Such addresses from your correspondence are not used for any other purpose and are not shared with outside parties.

Finally, we do not use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without providing you an opportunity to tell us not to allow such unrelated uses.

Children's Privacy

Protecting the privacy of the very young is especially important. For that reason, we do not collect or maintain information from those we actually know are under the age of 13.

Under no circumstances shall emBeadT or its Associates be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use the Site, including but not limited to reliance by a user on any information obtained at the Site, or that result from mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorized access to emBeadT records, programs or services. The foregoing limitation of liability shall apply whether in an action of contract, negligence, or other tortious action, even if an authorized representative of emBeadT has been advised of or should have knowledge of the possibility of such damages. You hereby acknowledge that this paragraph shall apply to all content, merchandise and services available through the Site. Disputes

Any dispute relating in any way to your visit to the Site or to products you purchase through the Site shall be submitted to confidential arbitration in Chicago, Illinois except that, to the extent you have in any manner violated or threatened to violate emBeadT's intellectual property rights, emBeadT may seek injunctive or other appropriate relief in any state or federal court in the State of Illinois, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this Agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
